Terms of Service
Effective date: [Effective date — to be set at launch]
This is template language provided for completeness and should be reviewed and adapted by qualified legal counsel before launch. Bracketed values are placeholders to be completed for your jurisdiction and entity.
These Terms of Service (the “Terms”) govern your access to and use of Skinda — our website, applications, AI skin-analysis features, and related services (together, the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. Who we are
The Service is operated by [Company legal entity](“Skinda,” “we,” “us,” or “our”). You can reach us at support@skinda.app or through our contact page.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Skinda. By using the Service you represent that you meet this requirement and that the information you provide is accurate. Skinda is not directed to children.
3. Cosmetic, not medical
Skinda is a cosmetic and informational tool, not a medical device, and does not provide medical advice, diagnosis, or treatment. Our AI skin analysis estimates visible cosmetic attributes from a photo and suggests over-the-counter products. Results are informational, vary from person to person, and are not a substitute for professional advice.
Always seek the advice of a licensed dermatologist or other qualified health provider with any questions about a skin condition, and never disregard or delay professional advice because of something you read on Skinda. See our full disclaimer.
4. Your account
Some features require an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly at support@skinda.app if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Photos and your content
To use the face scan you upload photographs of yourself. You retain ownership of your photos and other content. You grant us a limited licence to process your photos solely to provide the analysis and the features you request, as described in our Privacy Policy. You represent that you have the right to upload any image you submit and that it depicts you.
You agree not to upload images of other people without their consent, nor any unlawful, infringing, or offensive content.
6. Subscriptions, billing, and cancellation
- Skinda offers a free tier and paid Pro and Premium subscriptions. Current prices and what each plan includes are shown on our pricing page.
- Web payments are processed by Stripe; mobile in-app purchasesare processed by the Apple App Store or Google Play through RevenueCat. Your payment is subject to the relevant processor’s terms.
- Paid plans renew automatically at the end of each billing period (monthly or yearly) until cancelled. You authorize us (or the app store) to charge your payment method on each renewal.
- You can cancel anytime — from your account page (Stripe billing portal) on web, or in your App Store / Google Play subscription settings on mobile. Cancellation stops future renewals; your plan stays active until the end of the period already paid for.
- Except where required by law, payments are non-refundable. See our policies and your statutory rights, which are not affected by these Terms.
7. Acceptable use
You agree not to:
- reverse-engineer, scrape, or attempt to extract our models, data, or source code, or use the Service to build a competing product;
- misuse, overload, or interfere with the Service or attempt to bypass usage limits, security, or authentication;
- upload malicious code, or content that is unlawful, infringing, or that you have no right to submit;
- use the Service to provide medical advice to others or in any way that implies a clinical diagnosis.
8. Intellectual property
The Service, including its software, design, text, and the Skinda name and logo, is owned by [Company legal entity] or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial use, subject to these Terms.
9. Third-party products and links
Skinda recommends third-party skincare products and may earn affiliate commissions when you purchase through our links, at no extra cost to you. We are not the seller and do not manufacture, endorse, or warrant any third-party product. Always read product labels and patch-test new products.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the analysis is accurate, complete, or that the Service will be uninterrupted or error-free.
11. Limitation of liability
To the fullest extent permitted by law, [Company legal entity] and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will provide notice (for example, by email or an in-app notice). Your continued use of the Service after changes take effect means you accept the revised Terms.
14. Governing law
These Terms are governed by the laws of [governing-law jurisdiction], without regard to conflict-of-laws rules, and the courts of that jurisdiction will have exclusive jurisdiction, except where mandatory consumer-protection law provides otherwise.
